I received a really stupid email from Wave Riding Vehicles today. They allege that I am using their trademark term "wave riding vehicles" on one (or more) of my web pages (the MyPaipoBoards home page as it turns out). The violation in question is a description of the Nels Norene's Vagabond site:
"vagabondsurf.com is an open forum for the entire surfing world, featuring articles and pics of alternative wave riding vehicles and an alternative view of the surfing industry"
I really feel sorry for them to have wasted their time like that. In a reply to WRV, I suggested they use their lawyers to distinguish trademarks, servicemarks and copyrights, the the enforceble definition of trademark. Dorks!

Sorry to hear the old website is bringing heartache your way, Rod. I just went through a billion viagra ads looking to see if they sent me anything too, but so far, so good. Maybe they are just pissed you didn't get a WRV paipo, or maybe they are looking for new revenue to get them through a Clark foam shortage.
My site won't be up forever, but if I start getting a bunch of yuppie lawyer crap I might have to rethink the whole re-entrenchment program I'm on. Fortune favors the brave, eh? |

Thanks, Nels. LOL, I received a follow-up response from WRV this evening. I think they need to go waveriding or something. Her it is:
Dear Sir,
We received your response dated 1/9/06.
Wave Riding Vehicles diligently maintains the rights to it's Trademarks. The copyright referred to is in regards to the content on the website. There is always a Trademark accompanying our logos. We, including our counsel, are quite familiar with responses of all types and the subsequent actions that may be necessary. This is a friendly notice. Please proceed accordingly.

You could always point out it says "alternative wave riding vehicles", not "wave riding vehicles", and ask for legal clarification - that ought to be good for another $400 in lawyer fees, a legit cost of doing business for them to protect their trademark. Or a clarification to "The copyright referred to is in regards to the content on the website", which is rather nebulous...are they claiming copyright to all the content on your website?
Poobah, once upon a time you asked me about that copyright stuff - see how much fun it is?
I hate to sound so booge-wah, but the name "U.S. Fiberglass Corporate Office? pretty much su,s up what is wrong with surfing in 2006. Seems like a simple phone call to a real surfer or human being at WRV ought to be able to keep peace in the valley. |

There's a Surf Pulse editorial at

that also uses the phrase "alternative wave riding vehicles." It's about the discrimination towards non pedestrian surfers. I wonder if they were painted with the same brush as Rod. What's next for Rod? Will Hot Rod Magazine be after his first name? Worse yet...maybe someone owns the word "paipo." |

I changed it a few days ago to "vehicles for wave riding" (bugs the crap out of me since my workplace just HATES those passive voice prepositional phrases!). Still in "dialogue" over this really stupid BS. And certainly can't imagine their willingness to spend lawyering hours over something so inconsequential... and something they would lose if I hired a lawyer. I have a mental picture of legal firms wandering around cyberspace doing keyword searches and "making contact". What a sad, bad joke...and how emblamatic of modern surfing is this situation? |

Rod, when I lightheartedly suggested that change, I didn't think you were really going to change your site that quickly! It sounded to me as though you were going to fight these dweebs! Just taking the course of least resistance is often the best idea; I think you did the right thing. |

I can spar with them a little and just not tell them it was changed
and... I am really beginning to wonder about WRV's quality of service... I mean, if I you are an experienced waverider do you want to be waited on and advised by a 17yo nitwit kook?
